Company Privacy Policy

Pet Valu, Inc. (“Pet Valu US” “us” or “we”) recognizes the importance of privacy and the confidentiality of personal information. This Privacy Policy outlines how we collect, use, disclose and otherwise manage your personal information.

This Privacy Policy applies to our interactions with you and others who may visit our retail stores or any of our websites or with whom we may communicate by phone, email or on social media sites, such as Facebook, Twitter, Pinterest, YouTube and Google+.

Who is Pet Valu, Inc.?

Pet Valu, Inc. operates retail stores in the United States specializing in the sale of pet food, pet supplies and pet related services and operating under the names PET VALU or JACK’S PETS.

We operate the following websites: “us.petvalu.com” and “jackspets.com” (the “Sites”).

Our Canadian affiliate, Pet Valu Canada Inc., has its own privacy policy which can be found on the Canadian website at: petvalu.com/privacy-policy.

What is “personal information”?

“Personal information” is any information that directly identifies a particular individual, such as name, email address and other contact information.

How do we use your personal information?

Generally, we collect personal information from you in order to:

  • process retail transactions in the ordinary course of our business;
  • process and track returns and exchanges and to detect and protect against error or fraud as part of our loss prevention program;
  • administer our loyalty program(s);
  • respond to your questions and provide you with information about our products, services, and promotional activities;
  • track and analyze customer purchases, other transactions, shopping patterns and website browsing patterns on our Sites and across third party sites, for market analysis purposes or in order to make promotional offers to our customers;
  • improve our Sites, services and products, and to develop new products and services;
  • conduct surveys and analysis for research, statistical and product development purposes (information will be anonymized to the extent possible);
  • process, service, analyze and audit our customers’ relationship with us;
  • perform tests to implement or modify our systems;

  • How do we collect your personal information and what personal information?

    We collect personal information from you in a number of ways when you visit our retail stores or outlets, browse our Sites, or otherwise contact us. Such information may be collected directly or indirectly as described below:

    Information that is collected directly:

  • we may collect personal information such as your name, contact information, payment card information and purchase history when you purchase products or services at our retail stores or other retail outlets;
  • we may collect and use your contact information, which could include your name, address, and/or e-mail address, in order to provide you with periodic newsletters or updates, announcements and special promotions regarding our products and services;
  • when you contact us with a complaint or an inquiry, we may collect information that identifies you (for instance, your name, address or phone number) and any other information we may need in order for us to respond promptly to your complaint or inquiry;
  • telephone calls to and from our customer service help-desk may be recorded for training and support purposes and, when they are, you will be notified at the outset. Any personal information collected through such records will be used for us to respond to your complaint or inquiry as well as for training purposes with a view to improving our customer service;
  • when you complete the “Contact Us” box on our Sites, you may provide information that identifies you (for instance, your name, email address or phone number) and any other information you consider we may need in order for us to respond promptly to your complaint or inquiry;
  • when you complete the “Email Sign Up” box on our Sites, we may collect information that identifies you (for instance, your name and email address) in order for us to send you news, updates and promotions by email;
  • when you apply to join our loyalty program, you may be asked to provide certain information (for instance, your name, address, phone number, email address, as well as details regarding your pet(s)) as may be required in order for us to administer the program and to provide you with the benefits of such program;
  • when you voluntarily participate in our customer surveys or contests you may be asked to provide certain personal information (for instance, your name, province, city of residence, email address or phone number, and such other information related to the survey or contest) required for the purposes and administration of the survey or contest and any such information provided for a contest might be published or otherwise used as disclosed in the contest rules; and
  • when you apply to us for employment, you may be required to provide personal information so that we may assess your qualifications.
  • Information that is collected directly:

  • we automatically collect information through the use of cookies, web beacons, java script, log files, and other technologies, standard information from your Web browser (such as browser type and browser language); your IP address; and the actions you take on the Site or through the Services (such as the pages viewed and the links clicked, time logged in, activities taken); your domain name; your operating system; the length of time you visit our Site and or use our Services; and the referring URL, or the webpage that led you to our Site.   • Personal Information of Minors

    Our Sites have not been created with a view to targeting or otherwise marketing to children under the age of 13. The Sites are not intended for nor directed at users under the age of 13. We do not collect the ages of those who may visit our Sites and we do not knowingly collect personal information from users under the age of 13. If personal information is inadvertently collected from someone under the age of 13, upon being made aware of same, we will make best efforts to delete such data from our records as quickly as possible.

    Disclosure

    We may transfer or disclose personal information as follows:

  • your personal information may be transferred to our third-party service providers, agents and our affiliates (collectively, “service providers”) who provide support services required in order for us to properly serve you, such as customer service, web-site hosting, data management, market analyses, loyalty program administration, email marketing, and contest administration. We and our service providers may use servers for such purposes which may be located in Canada or other foreign country and, therefore, there is the possibility that your personal information may be processed and stored in Canada or such other foreign country. We require our service providers to protect the information in a manner that is consistent with this Privacy Policy;
  • your personal information may be transferred to certain of our suppliers of product for the purposes of providing the benefits of and administering the loyalty program or to inform them of any questions, concerns or complaints you may raise with us;
  • we may share your personal information with our affiliates or any third party business partner in the event we run a joint promotion, as will be specified when your personal information is requested and collected;
  • we and/or our service providers, suppliers, affiliates, or third party business partners with whom we may have shared your personal information as noted above, may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by law. We may also disclose your personal information where necessary for the establishment, exercise or defence of legal claims;
  • we also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of any terms of use or this Policy, or as evidence in litigation in which we are involved;
  • if we are acquired by a third party, or any of our assets are acquired, or in the event of a merger or bankruptcy, your personal information could be one of the assets transferred, and we may also disclose your information to a potential purchaser/acquirer or its advisors as part of their review of the acquisition or potential acquisition, as well as to facilitate the acquisition transaction and/or to ensure continuity in the services provided to you; and
  • we may share and disclose aggregate or de-identified information about users or derived from our users’ use of the Services with third parties for marketing, advertising, research, analytical or similar purposes.
  • Cookies and Tracking Technologies

    We and our service providers use cookies, clear GIFs, log files and other tracking mechanisms to collect information about your use of our Sites and Apps, as described above. We may combine this information with other personal information we collect from you.

    Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies or opting out of certain third party ad networks).

    Cookies. In order to provide you with a better browsing experience, we might make use of “cookies” which would make it easier for you to access the Sites during future visits. A “cookie” is a small text file that a site stores on your web browser and can later retrieve. Such cookies would enable us to distinguish you from other visitors to our Sites. You can choose to browse our Sites without accepting cookies, by selecting the appropriate settings on your browser to block or reject cookies. But, as cookies allow us to recognize you from page to page within our Sites, and they support your transactions with us, if cookies are disabled or not permitted, while you still would be able to browse our Sites, you might not be able to use the full functionality of our Sites.

    Third Party Cookies. Third party cookies may be set on your web browser by other websites whose services are used on the Sites. Cookies of this type include the sharing buttons across the Sites which would allow you to share content from our Sites onto social networks. Cookies are currently set on our Sites by Facebook, Twitter, Pinterest and Google+. In order to implement these buttons, and connect them to the relevant social networks and external sites, there are scripts from domains outside of our Sites. You should be aware that these other websites may be collecting information about your activity on the internet, including our Sites.     Web beacons (a.k.a clear GIFs and pixel tags). Web beacons are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages and within emails. We use these on our Site, along with cookies, to compile aggregated usage statistics and to analyze how our site is used. We may also use Web beacons in the HTML emails we send, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded. This allows us to gauge the effectiveness of our customer communications and marketing campaigns.

    Third-Party Analytics. We also use automated devices and applications, including Google Analytics, a web analytics service provided by Google, Inc. (“Google”), to collect information about the use of our Sites. Google Analytics and other analytics providers collect information such as how often users visit our Sites, what pages they visit when they do, and what other sites they visit prior to visiting to our Sites. We use the information we obtain from Google Analytics and other analytics providers to improve our Sites, products and services. These analytics providers may use cookies and other technologies to perform their services and collect the your IP address, page views and date and time stamps, as well other information, and they may combine the information that they collect about you on our Sites with other information that they have collected.     Third Party Advertising

    We work with third parties such as ad network operators, including Google Ads/DoubleClick (to review Google’s privacy practices and your choices regarding Google Ads, click here ), who assist us and others in displaying advertisements on third party websites, and to evaluate the success of our advertising campaigns. These third parties may display advertisements based on your visits to our Sites as well as other websites, in order to show you more relevant ads for products and services you might be interested. These third parties’ practices are governed by their own privacy policy, not this one. We may provide these third-party advertisers with information about your usage of our Sites, as well as other aggregate or non-personally identifiable information.

    You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”). Opting out of one or more NAI or DAA member networks (many of which will be the same) only means that those members no longer will deliver targeted content or ads to you.     Our Sites may contain links to other websites. We are not responsible for the privacy policies and/or practices on other websites and, when linking to another website, you should read the privacy policy of such website. Our links to such other websites are not intended to be an endorsement of or referral to the other websites. We do not have any control over such other websites and, therefore, have no responsibility or liability for the manner in which the entities that operate such other websites may collect, use or disclose, secure and otherwise treat your personal information.

    Special Information for California Consumers

    If you are a California resident you may request a list of certain third parties to whom we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us at the Contact Us address set out below. Please allow up to thirty (30) days for a response.

    Access to and Updating Your Information

    Since we use your personal information to provide services to you, it is important that the information be accurate and up-to-date. If, during the course of our relationship with you, any of your information changes, please contact us, at the Contact Us address noted below, to inform us of that change so that we can continue to provide you with our services. However, please note that we may maintain a copy of any such information as part of our business records.

    Your marketing preferences

    We will provide you with newsletters, special offers, new product announcements and other information about our stores, products and services by electronic communications (such as, email, text, social media) if we have received your consent to do so.     Is your personal information secure?

    We have implemented security measures to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security.

    Changes to this Privacy Policy / Contact Us

    Since we regularly review all of our policies and procedures, we may change our Privacy Policy from time to time without prior notice and such changes take immediate effect. If we make material changes to this policy, which materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting it on our Site or by notifying you by email.
